Sinteză a jurisprudenţei Înaltei Curţi de Casaţie şi Justiţie în materie procesual civilă în anul 2020

Rezumat

Although then year 2020 was marked by the SARS CoV 2 pandemic, and the judicial activity was significantly reduced during the state of emergency period, the same year may be considered as well, to be a reference year by reference to the large number of issues of civil procedural law on which the High Court of Cassation and Justice had the opportunity to rule on. Both the panel resolving the appeal in the interest of the law, and the panel clarifying certain issues of law rendered numerous decisions with a value of principle, which, besides the binding force attached to the solution adopted, are largely conclusive by deep, certainly thorough legal reasoning with the valence of guiding the judicial practice and contributing to the development of the science of the civil procedural law. With regard to the large number of such decisions, we deemed it useful to try to draft a summary intended to attempt, in an inherently concentrated and selective manner, to point out the main issues clarified by the supreme court.
