Rezumat

In a world marked by the imperialism of the economic science and strongly influenced by the market paradigm, law could not get rid of the economists’ dominating trends. The seizure of law by the economic science was made by using its own assumptions, models, methods and instruments, and the economic man model had a key role. Undoubtedly, the first pillar on which the economic analysis of law is built, shall be represented by the economic behaviour model, homo oeconomicus.
This article envisages taking stock of the essential elements, the objectives and characteristics of the economic man, as set up in the economic science, to further notice its relevance in law. Therefore, this study represents a contribution to the discussion about the image of the economic man in law, about his role and place in the law science and practice. The questions for which I am searching an answer shall consist of those whether law uses, consciously or not, the homo oeconomicus model, whether this model is useful in any manner and whether it can pick up correctly.
