Rezumat

Following the update of certain general issues relating to the action for the recovery of real property, in this study, the authors examine the specific issues of the action for the recovery of property in relation to the land book regulations.
Thus, the theoretical and practical situations which are possible in the matter of the action for the recovery of real property shall be examined, and a distinction shall be made, on the one hand, between the situations in which the estate is registered or not in the land book (namely, the estate is not registered in the land book; only the claimant is registered in the land book; only the defendant is registered in the land book; both parties are registered in the same land book; both parties are registered in different land books), and, on the other hand, between the existing situation until the entry into force of the rights building effect of the registrations in the land book and the perspectives subsequent to this moment.
