Abstract

Agriculture needs substantial investments to assure its development. When these investments come from „outside” questions are raised as to their legal regime on the territory of the host state. Foreign investors look for legislative guidelines and an effective contractual framework suitable for their activities. The ALIC Guide, developed by UNIDROIT in collaboration with IFAD, offers a body of good practices that can be used by all those involved in land investments.

After the brief presentation of the ALIC Guide, the issue of foreign investments in agricultural land in Romania will be analyzed, starting with the applicable national legislation and followed by a radiography of the forms and conditions in which foreign investors „approach” agricultural land in Romania. In the last part, the protection of foreign investors will be briefly discussed, distinguishing between the legal means available to investors with the nationality/citizenship of an EU member state and those outside the European space.
