Abstract

A recent jurisprudence of the High Court of Cassation and Justice, together with the continuation of our research in the matter of notarial procedures, prompted us to take a new look at the signature certification procedure. Although not used on the same scale as the authentication procedure, the signature certification procedure leads more frequently to documents used in the international circuit. In addition, documents with a certified signature, due to the reduced procedural rigors, can end up more frequently in front of the judge, in case of conflict. All this justifies the need for a new testing of this procedure under the current legislation.
